Rs. 50 Lakhs Deposit Directed as Security

Justice Prathiba M Singh also directed Canva to deposit Rs. 50 lakhs with the Registrar General as security for RxPrism’s claims regarding the past use of the infringing feature in India. The court based this decision on the revenue and sales figures of users who utilized the feature in the country before June 30, 2022.

RxPrism’s Suit Seeks Permanent Injunction

RxPrism Health Systems provides AI-based customer engagement services to pharmaceutical companies. They filed a lawsuit to obtain a permanent injunction against the infringement of their patent “My Show & Tell.” The patent was launched in May 2020. The court granted an interim order in favor of RxPrism. It suggested that the case seems to be in their favor and against Canva. The court emphasized that failure to grant the injunction could result in irreparable loss and injury to RxPrism.

Court’s Observations and Protection for RxPrism

The Delhi High Court’s interim order reflects its immediate action to protect RxPrism’s patent rights and potential financial damages. By restraining Canva from providing the “Present and Record” feature in India and requiring a substantial deposit as security, the court ensures adequate safeguarding of RxPrism’s claims during the ongoing litigation process. This legal development signals the seriousness of patent infringement issues and the importance of respecting intellectual property rights in the digital age.
