Draft Digital Personal Data Protection (DPDP) Bill to be presented in monsoon session

DPDP Bill is set to be tabled in the Parliament during the monsoon session, commencing on July 20. The lawmakers have listed the bill alongside other crucial legislative pieces, including The Press and Registration Of Periodicals Bill, 2023, and The Cinematograph (Amendment) Bill, 2019.This comes after the Union Cabinet’s approval of the revamped draft on July 5.

Second Attempt to Pass the Contentious Bill

This will be the second attempt by the union government to pass the bill. The previous iteration, known as the Personal Data Protection Bill, 2021, faced criticism from various quarters and received 81 proposed amendments from a joint parliamentary committee (JPC). In response, the government introduced a new and revamped version in November last year, proposing significant changes to the digital regulatory landscape.

Key Provisions of the DPDP Bill

The new DPDP Bill introduced the concept of data fiduciary and proposed reforms, such as granting users the right to give, manage, and withdraw consent for sharing information. It also enhances the accountability of social media platforms and envisions fines for entities violating data privacy norms. However, critics have raised concerns about the draft’s ‘vague’ provisions and its lack of differentiation between personal and sensitive personal data.

Part of India’s Ambitious Multi-Tier Digital Framework

The union government’s ambitious multi-tier proposed framework aims to cover all aspects of India’s digital ecosystem, and the data protection bill constitutes a crucial component of it. This framework includes the Telecommunication Bill and the upcoming Digital India Bill, which seek to update the decades-old Information Technology Act.

Future Prospects and Challenges

As the monsoon session introduces other bills, such as those pertaining to press and periodicals, it will comprehensively revamp India’s digital landscape. Especially given the upcoming Parliamentary elections next year.
