Three industry bodies representing the online gaming sector have submitted two separate applications for the formation of self-regulatory bodies (SRBs) in accordance with the online gaming rules introduced in April this year. These applications were drafted after extensive consultations with approximately 120 gaming startups. However, sources suggest that the Ministry of Electronics and Information Technology (MeitY) will likely take a minimum of three months to finalize the SRBs.

According to insiders, recent organizational changes within MeitY, coupled with the ministry’s focus on the data protection bill scheduled for discussion during the upcoming Monsoon Session of Parliament, are expected to cause delays in the approval process for the SRBs. Furthermore, the recent appointment of Amit Agrawal as the CEO of the Unique Identification Authority of India (UIDAI) has potentially impacted the decision-making timeline.

Earlier reports had indicated that MeitY would establish its own SRB if the industry failed to propose a viable alternative by the July 6 deadline. As per the online gaming rules, SRBs are responsible for classifying online games as permissible or not. The industry can have one or multiple SRBs, and all gaming companies must register with one of them to operate legally in India.

Collaborative Efforts and Applications by Industry Bodies

Sources reveal that the 120 gaming startups, primarily affiliated with the All India Gaming Federation (AIGF), E-Gaming Federation (EGF), and Federation of Indian Fantasy Sports (FIFS), joined forces to develop proposals for the SRBs. These proposals were then submitted through two distinct collectives.

One SRB application was crafted by approximately 100 AIGF-affiliated startups, while the remaining 20 startups, members of EGF and FIFS, collaborated to create another application.

AIGF CEO Roland Landers expressed, “We are aware that some organizations have approached MeitY and submitted applications for SRB designation under the gaming rules. The industry is currently awaiting government notification regarding the SRBs.” Landers emphasized the commitment to supporting members and the wider industry during the transition to the co-regulatory process once the SRBs are officially established. He believes that these rules will enhance safety and security for online gamers while facilitating the growth of Indian games.

Malay Kumar Shukla, secretary of EGF, confirmed that members of EGF and FIFS had worked together to form an SRB and submitted their application. Shukla also mentioned that numerous other gaming startups have expressed interest in joining the proposed SRB.

Focus on User Protection and No Wagering Games

Compliant with MeitY guidelines, the industry bodies prioritized user protection and ensured that their proposals prohibited any form of wagering in online games. This emphasis on responsible gaming aligns with the government’s objective to create a safe and secure gaming environment.

The SRBs, once established, will play a crucial role in regulating the online gaming sector by setting standards, monitoring compliance, and addressing any concerns related to player safety, fairness, and responsible gaming practices. The formation of SRBs will bring greater structure and accountability to the industry while safeguarding the interests of online gamers.

Awaiting Government’s Notification

With the submission of the applications, the online gaming industry is now eagerly awaiting the government’s notification of the SRBs. Once approved, the SRBs will provide a framework for effective self-regulation in the sector, enabling gaming companies to operate with confidence and ensuring a secure and enjoyable gaming experience for Indian players.
